Agreement to these Terms
These Terms of Service govern your access to and use of Poucho, including the Poucho website, mobile applications, widgets, account features, subscription features, sync services, and related support services.
Poucho is operated by M4D Solutions. By accessing or using Poucho, you agree to these Terms. If you do not agree, do not use Poucho.
Eligibility
Poucho is intended only for users who are at least 18 years old. By using Poucho, you confirm that you are 18 or older and have the legal capacity to agree to these Terms.
You are responsible for complying with the laws that apply where you live and use Poucho.
Health and safety disclaimer
Poucho helps you log nicotine pouch or snus use, create reduction targets, review progress, estimate nicotine and cost metrics, and receive reminders. Poucho does not provide medical advice, diagnosis, treatment, counselling, or emergency support.
Any plan, target, reminder, milestone, estimate, or progress insight is informational only and may be inaccurate if your inputs are incomplete or incorrect. You should speak with a qualified healthcare professional before changing nicotine use, especially if you have health concerns, withdrawal symptoms, or are using medication or other cessation support.
Accounts and sign-in
You may need an account to use some Poucho features. You agree to provide accurate information, keep your account secure, and notify us if you believe your account has been accessed without permission.
Poucho may support sign-in through third-party providers such as Apple or Google. Your use of those providers is also governed by their own terms and policies.
Your data, logs, and plans
Poucho stores and processes information you provide, such as onboarding answers, pouch logs, plan settings, notification preferences, progress metrics, and subscription status. You are responsible for the accuracy of the information you enter.
If you use a Poucho widget or quick action, the widget may add or remove pouch log entries from your device and sync those changes when available. You are responsible for reviewing your logs and correcting mistakes.
Subscriptions and billing
Some Poucho features may require a paid subscription. Purchases, renewals, cancellations, trials, refunds, and billing disputes are handled through the app store or payment provider you used, including Apple App Store or Google Play, under their rules.
Poucho may use RevenueCat to manage subscription status. Access to paid features may depend on our ability to verify your active entitlement.
Mobile app license
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use Poucho on devices you own or control for personal, non-commercial use.
You must not copy, modify, reverse engineer, decompile, disassemble, scrape, automate, resell, sublicense, or misuse Poucho, except where applicable law expressly allows it.
Acceptable use and termination
You agree not to use Poucho for unlawful activity, to interfere with or disrupt Poucho, to attempt unauthorized access to accounts or systems, to upload malicious code, to abuse support channels, or to use Poucho to build or support a competing product.
We may suspend or terminate access if we reasonably believe you have breached these Terms, created risk for Poucho or other users, or used Poucho in a way that is unlawful or harmful.
Intellectual property and feedback
Poucho, including its software, designs, text, graphics, names, logos, and other content, is owned by or licensed to M4D Solutions and is protected by intellectual property laws.
If you send us feedback, ideas, comments, or suggestions, you allow us to use them without restriction or compensation to you.
Availability, disclaimers, and liability
Poucho is provided on an "as is" and "as available" basis. We do not guarantee that Poucho will be uninterrupted, error-free, secure, available on every device, or that any plan or estimate will achieve a particular result.
To the fullest extent permitted by law, we exclude all warranties and will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or business opportunity arising from your use of Poucho.
Indemnity
You agree to indemnify and hold M4D Solutions harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Poucho, breach of these Terms, violation of law, or infringement of third-party rights.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
Changes, governing law, and general terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date. Your continued use of Poucho after updated Terms are posted means you accept the updated Terms.
These Terms are governed by the laws of England and Wales. If any part of these Terms is found unenforceable, the remaining parts will continue in effect.
Privacy and tracking technologies
Your use of Poucho is also governed by our Privacy Policy, which explains how we collect and use data, including analytics, product measurement, advertising pixels, cookies, device identifiers, and services such as Meta Pixel, TikTok Pixel, Google tags, and PostHog.
Marketing and analytics technologies that are not strictly necessary should be controlled through appropriate consent and opt-out choices where required by law.
